TINJAUAN FIQIH MUAMALAH TERHADAP AKAD PRAKTIK PESAN ANTAR MAKANAN GO-FOOD

Abstract

This study aims to determine the practice of contract on purchasing food through Go-Food online services in Tangerang in a review of contemporary fiqh studies. The method used is qualitative with a descriptive approach. Information was gathered from interviews and review of literature documents. The results of the study found differences in transactions when consumers ordered food with cash and non-cash payments. The cashless payment method made by Go-Pay contains one contract, namely wakalah bil ujroh, while the cash payment method given by consumers to drivers after food is received contains two contracts in one transaction, namely wakalah bil ujroh and qardh. The contemporary muamalah fiqh poignancy found that the selection of non-cash consumer payments is legally permissible and cash payments are haram because they contain two contracts in one contract or also known as hybrid-contracts.
